This document is in draft form and is subject to legal review. Content may change before final publication.
1. Introduction
These AI Terms of Service ("AI Terms") supplement our Terms of Service and govern your use of AI-powered features within the Aliff Solutions platform, including but not limited to:
- Aliff Copilot — our conversational AI advisory interface
- Win Probability (pWin) Engine — Bayesian analysis of contract win likelihood
- Recompete Predictor — early warning system for contract rebids
- Incumbent Vulnerability Scorer — competitive position analysis
- Price-to-Win Calculator — data-driven pricing recommendations
These features are powered by artificial intelligence and machine learning models. By using any AI-powered feature of the platform, you acknowledge and agree to these AI Terms in addition to our general Terms of Service.
2. Advisory Nature of AI Outputs
All AI-generated outputs are advisory in nature. They do not constitute legal, financial, procurement, or professional advice.
Aliff Copilot and all analytical engines provide data-driven insights intended to assist qualified professionals in making informed decisions. These outputs are not a substitute for the judgment of experienced capture managers, pricing officers, compliance specialists, contracts attorneys, or other qualified professionals.
You should not rely solely on any AI-generated output when making business decisions, including but not limited to bid/no-bid decisions, pricing submissions, teaming arrangements, or compliance determinations.
3. Win Probability Analysis Limitations
The Win Probability (pWin) Engine uses Bayesian statistical methods to estimate the likelihood of winning a government contract opportunity. These probability scores:
- Are statistical estimates based on historical patterns and available data, not guarantees or predictions of actual outcomes
- May not account for all relevant factors including non-public evaluation criteria, undisclosed competitor capabilities, or changes in agency priorities
- Should be used as one input among many in your capture management process, not as the sole basis for bid/no-bid decisions
- Are constrained between 2% and 95% to reflect inherent uncertainty in all competitive procurements
Aliff Solutions assumes no liability for business decisions made in reliance on pWin scores, including decisions to pursue or not pursue specific contract opportunities.
4. Pricing Analysis Limitations
The Price-to-Win Calculator provides pricing ranges derived from publicly available federal benchmarks including GSA CALC labor rate data and USAspending.gov award records. These pricing recommendations:
- Are reference ranges, not bid prices — they should not be submitted directly in any proposal without independent validation by qualified pricing professionals
- Use wrap rate calculations that are illustrative and may not reflect your organization's actual indirect rate structure
- Do not account for your specific cost structure, overhead rates, profit margins, or contractual obligations
- May not reflect current market conditions, labor shortages, or geographic cost variations at the time of your proposal submission
You are solely responsible for all pricing decisions in your proposals. Aliff Solutions is not liable for any financial consequences resulting from pricing based on platform outputs.
5. Professional Judgment Required
All AI-powered features of the Aliff Solutions platform are designed to augment, not replace, professional human judgment. You agree that:
- A qualified professional will review all AI-generated outputs before they are used in any business decision, proposal submission, or client deliverable
- You will not submit AI-generated proposal content, compliance matrices, or analytical outputs to any government agency without independent professional review
- You will verify all regulatory citations, FAR/DFARS clause references, and agency-specific requirements independently before relying on them
- The platform does not replace the role of capture managers, pricing officers, proposal managers, contracts specialists, or legal counsel in your organization
6. AI Training and Data Sources
Aliff Copilot is a purpose-built AI model fine-tuned on government contracting domain knowledge. Our training data includes:
- Publicly available government procurement data from sources including SAM.gov, FPDS.gov, USAspending.gov, and the Federal Register
- Published Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) provisions
- Publicly available government contracting guidance, regulations, and industry best practices
Client Data Usage for Training and Service Improvement
By using the platform, you acknowledge and agree that Aliff Solutions may collect and use data generated through your interactions with AI-powered features — including queries, feedback, corrections, and usage patterns — for the purposes of:
- Improving the accuracy, relevance, and performance of Aliff Copilot and all analytical engines
- Training, fine-tuning, and evaluating AI models to better serve government contracting use cases
- Developing new features and capabilities based on aggregated usage patterns
- Conducting quality assurance, safety testing, and bias detection
Anonymization and Aggregation: Before any client data is used for model training or improvement, it is anonymized and aggregated so that no individual client, organization, bid strategy, pricing model, or proprietary business information can be identified or reconstructed. We employ industry-standard de-identification techniques including removal of organization names, contract numbers, personnel identifiers, and proprietary financial data.
Opt-Out: You may request that your organization's data be excluded from future AI training activities by contacting us through our contact page. Opt-out requests will be honored within 30 days. Note that opting out does not affect data already used in training prior to your request, as de-identified data cannot be retrospectively attributed.
No Cross-Client Exposure: Your proprietary data — including pipeline information, bid strategies, pricing models, competitive intelligence, and internal communications — is never shared with or made accessible to other clients in any form, whether through AI model outputs or otherwise. All client data is processed within organization-isolated environments with strict multi-tenant security controls.
For complete details on how we process your data, see our Privacy Policy and Data Processing Agreement.
7. Accuracy Limitations
AI models, including Aliff Copilot, may produce outputs that are factually incorrect, incomplete, or misleading. This is an inherent limitation of current AI technology. Specifically:
- The model may generate inaccurate regulatory citations, FAR/DFARS clause numbers, or agency-specific requirements — always verify against authoritative sources
- Historical contract data and award information may contain errors from source databases or may be outdated
- The model may present generated content with apparent confidence even when the underlying information is incorrect or fabricated
- Recompete predictions and incumbent vulnerability scores are probabilistic assessments that may not accurately reflect actual contract outcomes
Aliff Solutions makes commercially reasonable efforts to ensure accuracy and regularly updates its models and data sources, but does not guarantee the accuracy, completeness, or timeliness of any AI-generated output.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- Aliff Solutions shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of or reliance on AI-generated outputs, including but not limited to lost profits, lost bids, or lost business opportunities
- You agree to indemnify and hold harmless Aliff Solutions FZC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of AI-generated outputs in proposals, pricing submissions, or any communications with government agencies or other third parties
- Our total aggregate liability for all claims related to AI-powered features shall not exceed the fees paid by you for platform access during the twelve (12) months preceding the claim
This limitation of liability applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if Aliff Solutions has been advised of the possibility of such damages.
